Terms and conditions

The following booking conditions form the basis of your contract with Little Big Adventures Limited (trading as Little Big Adventures), company registration number 10185048 registered at 2a Wilmosts Close, Reigate, Surrey, RH2 0NP.

Please read them carefully as they set out our respective rights and obligations. By asking us to confirm your booking, we are entitled to assume that you have had the opportunity to read and have read these booking conditions and agree to them.

The following Terms and Conditions as well as Rules of Participation contained herein shall apply to all bookings made with Little Big Adventures. Little Big Adventures accepts bookings only made by persons aged 18 and over. On the payment of a deposit or balance for a booking on any Little Big Adventure trip by you, the client (participant), or where a group makes a booking, all participants within the group, acknowledge that they have read and understood these Terms and Conditions as well as Rules of Participation and agree to be bound by them. By booking with Little Big Adventures you, the client are accepting that Little Big Adventures will not be liable for any loss, damage, action, claim, costs or expenses which may arise in consequence of your participation in the trip.

These booking conditions only apply to holiday arrangements which you book with us in the UK and which we agree to make, provide or perform (as applicable) as part of our contract with you.

All references in these booking conditions to “holiday”, “booking”, “contract”, “package”, “trip”, “adventure”, “Little Big Adventure”, “tour” or “arrangements” mean such holiday arrangements unless otherwise stated.

In these booking conditions, “you” and “your” means all persons named on the booking (including anyone who is added or substituted at a later date) or any of them as the context requires. “We”, “us” and “our” means Little Big Adventures Limited t/a Little Big Adventures.

1. Legal Jurisdiction

All terms and conditions between clients and Little Big Adventures Limited are governed by English law and under the jurisdiction of the courts of England and Wales. We both agree that English law (and no other) will apply to your contract and to any dispute, claim or other matter of any description which arises between us.

2. Insurance & Liability

2.1 Adequate and valid travel insurance is compulsory for all Little Big Adventure travellers and it is a condition of accepting your booking that you agree you will have obtained adequate and valid travel insurance for your booking by the date of departure. We recommend that you take out insurance as soon as your booking is confirmed.

2.3 This must include sufficient and suitable cover for the activities to be undertaken during the trip. Participants are solely responsible for their own safety and emergency. You must bring all insurance documentation with you at the time of the activity.

2.4 You herby authorise leader or representative of Little Big Adventures Limited to make a decision to instigate a search and rescue including helicopter rescue if such assistance is suspected or confirmed to be needed either involving you or the group of which you are a member without previously obtaining the permission of the company issuing your insurance policy. You agree to indemnify the Company and keep the Company indemnified from all losses, apportioned appropriately to you, arising from any such search, any such helicopter usage and any resulting repatriation, for medical or non­medical reasons, including legal costs of making a recovery against you. Costs incurred by you, the client, due to an evacuation, rescue or other emergency event shall be your responsibility. Any subsequent costs incurred for expenses not limited to but including such costs as hotels, food, transport etc shall be borne by you, the client. It is therefore essential that adequate cover is in place. We strongly recommend that you take out an insurance policy at the same time as booking.

2.5 It is your responsibility to be fully aware of the implications involved in arranging your own travel insurance and understand the limitations and exclusions of the policy. We reserve the right to cancel your booking at any time if we are not satisfied you have the necessary insurance policy covering your activity.

2.6 Little Big Adventures shall not be held responsible for any injury sustained during the holiday or for any financial costs associated with medical care, search and rescue or repatriation. We also recommend your insurance covers you for trip cancellation and baggage loss/damage. Little Big Adventures are unable to accept responsibility for the loss or damage to any client equipment or luggage.

2.7 Little Big Adventures shall not be responsible for any injuries, damages, or losses caused to any traveller in connection with any terrorist activities, social or labour unrest, mechanical or construction failures or difficulties, diseases, local laws, climatic conditions, criminal acts or abnormal conditions or developments, or any other actions, omissions, or conditions outside the control of Little Big Adventures.

3. Travelling

Participants assume complete and full responsibility for travelling to and from a Little Big Adventure trip, unless explicitly set out in the adventure itinerary. Participants are solely responsible for checking and verifying any passport, visa, vaccination or other entry requirements for each destination, as well as all safety or security conditions at such destinations. Failure to arrive at the designated start time and location of the holiday stated in the itinerary may mean you forfeit the entire trip. You, the client will need a valid passport if travelling outside your country of residence and since some of the trips move through a few countries you will need to keep this on your person for the duration of the holiday.

4. Communication

We will communicate with you by e­mail in relation to your booking. You must accordingly check your e­mails on a regular basis.

5. Paying a Deposit

5.1 In order to confirm your chosen Little Big Adventure, a deposit of £75.00 per person (please note that depending on your chosen trip the required deposit may be different. If it is we will advise you accordingly at the time of booking) must be paid at the time of booking.

5.2 This deposit is non­refundable if you choose to cancel. You will be sent a booking confirmation receipt together with further information regarding the activity you have booked.

6. Balance of Payment

This is due 42 days (6 weeks) prior to the activity start date. If we do not receive all payments due in full and on time, we are entitled to assume that you wish to cancel your booking.

7. Financial Protection

7.1 The Package Travel, Package Holidays and Package Tours Regulations 1992 require us to provide security for the monies that you pay for the trip/s booked from us in the event of our insolvency.

7.2 Little Big Adventures’ trips are not ATOL protected as our trips do not include air travel. We are a tour operator and do not book flights for clients.

8. Medical Conditions & Dietary Requirements

If you are affected by a medical condition which may affect your or other people’s enjoyment of the adventure, you must advise this at the time of booking. Similarly, you must advise us of dietary requirements at the time of booking.

9. Complaints Procedure

If you have a complaint about the trip you should make it known to your guide/leader at the earliest opportunity and we will try to resolve the issue right away. Any outstanding complaint not

resolved during the trip should be notified to us in writing within 30 days of the scheduled date of return.

10. Adventure Travel and Client Responsibility

It is a fundamental booking condition that you accept the hazards involved in this sort of trip and you accept that in visiting remote and mountainous regions there is an element of on­tour flexibility. The itinerary stated in the trip dossier is indicative only and not a guarantee that a particular route will be followed or place reached. You must acknowledge that delays and alterations and their results, such as inconvenience and discomfort, are possible where unforeseen circumstances arise. You must have a level of fitness commensurate with your chosen trip and you are responsible for bringing the appropriate equipment, details of which will be sent to you at the time of booking. If, in the opinion of the Little Big Adventure Guide or Leader, your fitness or equipment may compromise the safety of a trip we reserve the right to cancel or terminate your holiday. In these circumstances you will not be entitled to a refund nor compensation.

11. Personal Risk

In choosing to undertake activities in a mountain environment, on lakes, rivers or inland waterways, you accept that these activities may pose a danger of personal injury or even death. Snowshoe hiking, hiking, paddle boarding, mountaineering, stand up paddle boarding are all inherently risky activities. All clients must be aware of and accept these risks and be responsible for their own actions and involvement in such activities.

12. British Standard BS 8848:2014

Little Big Adventures Limited maintains high professional standards of client care and safety. Little Big Adventures complies with BS 8848:2014, which is the British standard for organising and managing expeditions and adventurous activities outside the UK.

13. Photos and Media

You consent to us using images or video of you taken during the trip for advertising and promotional purposes in any medium we choose. You grant us a perpetual, royalty­free, worldwide, irrevocable licence to use such images for publicity and promotional purposes.

14. Cancellation

13.1 If you cancel more than 6 weeks (42 days) before start date you will lose your deposit. If you cancel within 6 weeks, you will lose the full payment of the adventure.

13. 2 Before you enter into a contract with us, we reserve the right to change any of the facilities, services or prices described in our brochure or website. We also reserve the right to cancel the holiday. For example, if the minimum number of clients required for a trip is not fulfilled, we may have to cancel your holiday. It is unlikely we will have to make any changes to your holiday and any changes are usually very minor. If a major change becomes necessary, we will inform you as soon as reasonably possible if there is time before your holiday begins. A major change is an alteration of the start or finish time of your holiday by more than 12 hours, a change of holiday location or a change to a lower standard of accommodation. When a major change or cancellation occurs you will have the choice of either accepting the change of arrangements, purchasing another available holiday from us, or cancelling your holiday. We will refund all payments made directly to us in respect of the holiday cost and travel insurance. We will not refund any personal expenses you may have incurred as a result of your booking such as flight payments for land­only trips, travel insurance, equipment purchases, visas, vaccinations etc. Where a major change or cancellation arises from circumstances amounting to force majeure (see below), we will endeavour to refund all sums as yet unpaid by us to our suppliers, however it is your responsibility to claim the remainder of any irrecoverable payments and charges from your travel insurers.

15. Limitation of Liability

15.1 We will accept liability for the negligence of our staff or agents causing death or physical injury to persons or loss or damage to personal property only to the extent it is obliged under the applicable law. Our obligations, and those of our suppliers providing any service or facility included in your holiday, are to take reasonable skill and care to arrange for the provision of such services and facilities.

15.2 We cannot be held responsible for any mishap to yourself or your property, and in particular for the consequences of flight cancellations, vehicle accidents, strikes, sickness, Government or customs or police intervention or other such happenings amounting to force majeure.

15.3 Little Big Adventures Limited and its employees are covered by public liability insurance up to a maximum of £5,000,000 in any one event. By signing up for a trip you acknowledge that we have taken all reasonable steps to safeguard its liability in this respect. We shall not be liable for any damages caused by the total or partial failure to carry out the holiday if such failure is:

attributable to anyone other than the Little Big Adventures’ staff; unforeseeable or unavoidable and attributed to a third party unconnected to us; a result of unusual or unforeseeable circumstances, reasonably beyond the control of Little Big Adventures; a result of an event which Little Big Adventures could not foresee

16. Accommodation

Accommodation is usually in 2­person tent or mountain cabin with shared sleeping quarters unless stated otherwise. We are not able to accommodate requests for single rooms, and you may be sharing with a member of the opposite gender.
